Terms of Service

These Terms govern your access to and use of IncidentLead, a service operated by Genesis One ("IncidentLead," "we," "us"). By creating an account or using the service, you agree to these Terms. If you don't agree, don't use the service.

01 The service

IncidentLead provides real-time property-incident alerts and associated property and owner contact information to licensed restoration contractors. It is a data and software tool. We do not place calls, do not contact property owners on your behalf, and are not a party to any agreement between you and a property owner. We do not guarantee any job, lead volume, revenue, exclusivity, or the accuracy, completeness, or timeliness of any data.

02 Eligibility

IncidentLead is available only to licensed contractors. You must hold a current, active contractor license (CSLB in California, or the equivalent in each state where you operate) in good standing and maintain it for as long as you use the service. We may suspend or terminate access if your license lapses.

03 Your responsibilities

You are solely responsible for all outreach you conduct and for its compliance with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the National and state Do-Not-Call rules, state telemarketing and consumer-protection laws, disaster-solicitation laws, and all licensing and contracting requirements. IncidentLead provides data and software only. Specifically, you agree that:

04 Acceptable use

You will not resell, sublicense, share, or redistribute the leads, data, or feed; scrape, copy in bulk, reverse-engineer, or build a competing dataset from the service; use the service for anything other than your own restoration business; or use it for any unlawful purpose, including harassment or discrimination.

05 Data accuracy

Incident data comes from public sources; owner and contact data comes from third-party providers. All of it is provided "as is," and we make no warranty as to its accuracy, completeness, availability, or timeliness. You must independently verify any information before relying on it or contacting anyone.

06 Messaging

If you provide a mobile number, you may receive SMS lead alerts and account notifications from us. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, or get help by replying HELP. How we handle your messaging information is described in our Privacy Policy.

07 Fees

IncidentLead is offered as a paid subscription. Current pricing, billing cycle, and cancellation terms are provided during onboarding. We may change fees on reasonable notice.

08 Termination

Either party may terminate at any time on reasonable notice. We may suspend or terminate your access immediately for breach of these Terms, for any compliance or licensing concern, or to protect the service or third parties. On termination, your access ends. Sections that by their nature should survive will survive.

09 Disclaimer of warranties

The service and all data are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any lead will result in business.

10 Limitation of liability

To the maximum extent permitted by law, IncidentLead will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or revenues. Our total aggregate liability arising out of or relating to the service or these Terms will not exceed the fees you paid to us in the three months before the event giving rise to the claim.

11 Indemnification

You will indemnify and hold harmless Genesis One and its owners, employees, and agents from any claims, liabilities, damages, penalties, and costs (including reasonable attorneys' fees) arising out of or relating to your use of the service, any call or message you make, any violation of the TCPA, TSR, Do-Not-Call, or any telemarketing, consumer-protection, licensing, or disaster-solicitation law, or your breach of these Terms.

12 Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The exclusive venue for any dispute is Los Angeles County, California.

13 Changes

We may update these Terms. If we make material changes, we'll take reasonable steps to let you know. Your continued use of the service after changes take effect means you accept the updated Terms.
